A judge imposed a $70,000 fine on concrete formwork company Avenue Building Corporation on June 4 in connection with a worker injury, according to an Ontario Ministry of Labour court bulletin.
The injury occurred on Feb. 12, 2013, at a high-rise construction project at 2157 Lake Shore Blvd. W. in Toronto. The ministry stated that a carpenter employed by the company and a second worker were trying to position a large wall form using a 12-foot-long, four-inch by four-inch piece of lumber as a lever. The piece of lumber broke, causing one of the workers to stumble forward, trip and fracture a leg.
The ministry cited Ontario Regulation 213/91 (the Construction Projects Regulation), which sets out that “material or equipment at a project shall be stored and moved in a manner that does not endanger a worker.”
The incident went to trial and, on Feb. 3, the company was convicted under the Occupational Health and Safety Act. The fine was imposed in court on June 4.
